E-Sign & Electronic Communications Notice

YOUR CONSENT TO ELECTRONIC DELIVERY (“Consent Statement”)

You are applying for or using products and services from Pontech L.L.C-FZ. (“XPlace”). If you consent to this E-Sign & Electronic Communications Notice (“Consent”), it applies even if you later open additional XPlace products. Your affirmative consent to this Notice allows XPlace to provide legally required disclosures, notices, agreements, statements, receipts, and other communications (together, the “Covered Items”) to you electronically through the XPlace app, dashboard, emails, in-app messages, or other electronic means we designate. If you do not consent to electronic delivery, you will not be able to use certain XPlace products and services. By registering for a XPlace account, applying for a card, or accessing the XPlace app or dashboard, you agree that such registration constitutes your signature, and you consent to electronic delivery of Covered Items.

You have the right to receive Covered Items by paper mail. We may instead provide Covered Items electronically if you give us your Consent and satisfy the system requirements below. References to “we,” “us,” and “our” mean Pontech L.L.C-FZ. and our service providers.

Duration of Consent

Your Consent remains effective until: (1) you or we terminate the relevant XPlace product or program; or (2) you withdraw your Consent as described below. If you terminate a product (for example, a card), your Consent will still apply to pre-termination rights and obligations associated with that product.

Methods of Providing Covered Items

“Provide” means to deliver, make available, send, notify, or similar. We may provide Covered Items electronically, including through files (e.g., PDFs) available in the app or dashboard or downloaded from our website. It is your responsibility to review Covered Items promptly so you can take appropriate action.

Access to Paper Copies

You may save or print Covered Items using your device’s “save” or “print” functions. We retain copies for time periods required by law and will provide copies upon request during those periods. We may not retain copies longer than required by law. Save or print Covered Items to ensure you have them when needed. You may request a paper copy at no cost by emailing [email protected].

Our Right to Send Paper

We may provide Covered Items in paper form at our discretion even after you consent to

electronic delivery (for example, if there is a system outage or we suspect fraud).

Hardware and Software Requirements

To access and retain Covered Items, you must have a computing/device environment with:

– working Internet access;

– a current web browser that supports TLS/SSL encryption (for example, the latest versions of Chrome, Firefox, Edge, or Safari);

– the ability to receive email and open hyperlinks;

– software capable of opening and saving PDF files (for example, a PDF reader); and

– sufficient storage space to save Communications or a printer to print them.

By providing your Consent, you confirm you meet these requirements and can access and retain this Notice electronically.

Withdrawing Consent

You may withdraw your Consent at any time at no charge by emailing [email protected].

Withdrawal may delay or prevent your ability to use certain XPlace products or services

(including opening or using a card). Any withdrawal will not affect the legal effect, validity, or enforceability of Covered Items already provided.

Acknowledging Ability to Access and Consenting to Electronic Communications

By confirming that you have read and agree to these terms, you acknowledge that (1) you have

access to a device that meets the system requirements set forth above; (2) you agree to receive

Covered Items electronically; and (3) you are able to access, review, and print or store the

information presented to you.
